Deren is a Special Counsel with expertise in commercial litigation and dispute resolution. He acts in the High Court and has appeared in various federal and state Courts and specialised Tribunals. Deren is experienced in all aspects of litigation from strategic pre-litigation advice to the commencement of proceedings, interlocutory applications, retaining experts and counsel, preparing evidence and conducting hearings and appeals.
Deren practises in commercial and corporate disputes, joint venture and partnership disputes, debt recovery and insolvency, consumer law, professional misconduct and disciplinary matters, healthcare and building disputes. He has particular expertise in real estate disputes and various facets of property litigation including co-ownership, caveat, easement, land and equity matters and industrial, commercial and retail tenancy disputes. Deren is skilled in alternative dispute resolution techniques. He is a Resolution Institute trained mediator and has mediated for the Office of the NSW Small Business Commissioner.
Deren acts for private and listed companies, property trusts, financial institutions, superannuation funds, shopping centre owners, major landlords and retailers, property developers as well as manufacturers, security, technology and construction companies. His clients value his ability to deliver commercially strategic outcomes.
Acted for a serviced apartment operator in the High Court to successfully oppose a special leave application on the grounds the application raises no point of general principle or issue of public importance and does not seek revision of settled principles relating to jurisdictional error
Recovered $6 million, holding costs and other losses in Supreme Court for a JV investment party who funded land acquisition against other JV developer party who failed to deliver project construction
Acted for private technology company receiving government subsidies for installing internet in remote and regional areas to avoid a Supreme Court wind up application by proving solvency and settling various debts of creditors queued up to substitute the applicant creditor
Assisted creditor client in establishing entitlement to set-off a debt against a liquidator’s unfair preference claim
Sought relief in the Supreme Court for a minority shareholder who was unfairly prejudiced and oppressed by the improper diversion of corporate business to majority shareholders
Successfully recovered brokerage fees for a multi-national brokerage firm whilst defeating share-trader’s allegations the broker promised certain results
Obtained orders in the Supreme Court for parties who built a house on land on broken promise by the landowner that the property would be subdivided
